By visiting our website and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as ‘User Agreement’), along with the terms and conditions as stated in our Privacy Policy.

We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this user agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement with the modified terms and conditions.

RESPONSIBLE USE AND CONDUCT

We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.

THIRD-PARTY WEBSITES

We are active on third-party sites such as Facebook, Twitter and LinkedIn. These are only for sharing or listing purposes and we take no responsibility for these sites or their contents listed on our website. We deny all liabilities and take no responsibility for the content that may be posted on such third-party websites by the users of such websites including the comments posted by them. Neither we nor any third party provide any warranty as to the accuracy of the information and products offered on this website. You acknowledge that such information and products may contain some errors or inaccuracies at any point in time.

PRODUCT ACCURACY

The images of the items on the website are for illustrative purposes only. Although we have made every effort to display the colors accurately, we cannot guarantee that your computer’s display of the colors accurately reflects the color of the items. Your items may vary slightly from those images. All sizes and measurements of items are approximate; however, we do make every effort to ensure they are as accurate as possible. We take all reasonable care to ensure that all details, descriptions, and prices of items are as accurate as possible.

PRODUCT PRICING

We make sure that all the pricing details appearing on the website are accurate. However, errors may occur; in that case, information would be provided to you if an order has been placed by you. If you want to cancel the order we will help you and refund the amount (if already been paid). If we are unable to connect with you we will cancel that order. Also, prices for items may change from time to time without any prior notice. However, it would not affect the orders that have already been dispatched. The price of an item includes GST taxes at the prevailing rate for which we are responsible as a seller.

PRIVACY

Your privacy is very important to us, which is why we’ve created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. DELIVERY

While placing an order you will be given various options for delivery and this will vary depending on the area from which you want to place the order. After placing an order you will receive an email confirmation describing the details of your order and the estimated time. Generally, the maximum estimated delivery time is 7-10 business days. At times the delivery to its destination may take longer than the estimated time due to unforeseen circumstances for which the management will not be responsible. However, we will reach you by e-mail or SMS.

LIMITATION OF WARRANTIES

By using our website, you understand and agree that all resources we provide are “as is” and “as available.”

LIMITATION OF LIABILITY

In conjunction with the Limitation of Warranties, as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for the use of products and/or services. DesiDelights will not be liable for any direct, indirect, incidental, consequential, or exemplary loss or damages that may be incurred by you as a result of using our resources or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitations of liability laws apply.

TERMINATION OF USE

You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and resources with or without notice and for any reason, including, without limitation, a breach of this User Agreement. Any suspected illegal, fraudulent, or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.

RETURN AND REPLACEMENT

LAW AND JURISDICTION

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Gurgaon.
